NAVICO CONNECT LIMITED CONSUMER WARRANTY - AMERICAS

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
NAVICO GROUP LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT (OR IF APPLICABLE, REFUND) AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.
1. Limited Performance Warranty
Navico Group (“Navico”) warrants to the first retail purchaser that the Connect System when used in an approved application and configured in accordance with Navico’s instructions will be materially free from defects in materials and workmanship during the warranty period (“Warranty Period”) defined below. Subject to the terms and conditions of this limited warranty, during the Warranty Period Navico will, at its option, repair or replace any part(s) in the Connect System that are determined by Navico to be defective. If, in Navico’s discretion, repair or replacement is not feasible, Navico will refund purchaser the purchase price for the Connect System in lieu of repair or replacement. Navico reserves the right to modify the availability of this limited warranty at our discretion, but any changes will not be retroactive. Navico reserves the right to request any part claimed under this limited warranty be returned to Navico.
“Connect System” refers to a collection of parts and components, either manufactured by Navico or third-parties, that are intended to function together as an integrated system and which have been designed and validated by Navico for use in an approved application. The Connect System does not include any parts or components not approved by Navico for use in the system.
2. Warranty Period
Non-Commercial. For Connect Systems not used in a Commercial Application, this limited warranty applies for five (5) years from the date of first retail purchase or the date on which the Connect System is first put into service, whichever occurs first.
Commercial Use. For Connect Systems used in a Commercial Application, this limited warranty applies for three (3) years from the date of first retail purchase or the date on which the Connect System is first put into service, whichever occurs first.
“Commercial Application” means any use of a Connect System other than for personal or recreational purposes. By way of illustration, Commercial Applications may include, without limitation, use in connection with professional services (including emergency response services) and/or business-related endeavors that are intended to generate profit.
Warranty Period(s) are not extended if Navico repairs or replaces a warranted Connect System or re-performs a warranted service.
3. Third-Party Products
Parts and components not manufactured by or on behalf of Navico are not covered under this limited warranty. To the extent that Navico receives a warranty from a third-party manufacturer for any equipment purchased for incorporation into the Connect System, Navico will assign its rights under those warranties to the consumer.
4. Exclusions
This limited warranty does not cover normal wear and tear, cosmetic blemishes, or any damage due to: (a) transportation; (b) storage; (c) improper use (including use of the product in a manner other than as intended by Navico); (d) failure to perform preventive maintenance; (e) modifications; (f) unauthorized repair; (g) use of accessories or parts not manufactured by Navico; or (h) external causes such as accidents, abuse, malware and/or computer viruses, or other actions or events beyond Navico’s control. DAMAGE CAUSED BY THE USE OF OTHER REPLACEMENT PARTS NOT MEETING THE DESIGN SPECIFICATIONS OF THE ORIGINAL PARTS WILL NOT BE COVERED BY THIS LIMITED WARRANTY.
This limited warranty does not cover any costs for haul‑out, dockage, launch, towing and storage, shop supplies, overtime or premium labor fees, transportation charges and/or travel time, telephone or rental charges of any type, inconvenience, or loss of time or income, or other consequential damages.
Consumable items, whether repaired or replaced, are not covered by this limited warranty. Consumable items include, but are not limited to, fuses, batteries, bulbs, bearings, motor brushes, drive-belts, magnetrons, paddlewheels, paddlewheel bearings, paddlewheel blades and paddlewheel shafts, hard disks, and/or fans.
This limited warranty does not apply if Navico was not notified by the consumer of the alleged defect or malfunction of the product during the Warranty Period. Products where the serial number has been altered, mutilated or removed are not covered under this Limited Warranty.
Product that is either first sold or put into service more than six (6) years from date of manufacture is excluded from this Limited Warranty.
Unless otherwise stated, this limited warranty does not apply to multifunctional displays (“MFD’s”) included in the Connect System. For warranty coverage for MFD’s, please refer to the applicable brand’s warranty policy for details and availability.
This limited warranty only applies to Connect Systems designed and/or sold by Navico Group Americas LLC in the Americas region and does not apply to other entities and regions where Navico designs and sells Connect Systems.
5. Limitations on Liability
THE REMEDIES DESCRIBED ABOVE ARE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES AND NAVICO’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY.
NAVICO SHALL NOT UNDER ANY CIRCUMSTANCES, WHETHER AS A RESULT OF BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, STRICT LIABILITY OR OTHERWISE, BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR EXEMPLARY OR PUNITIVE DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS OR REVENUES, LOSS OF OTHER GOODS OR ASSOCIATED EQUIPMENT OR DAMAGES TO ANY ASSOCIATED EQUIPMENT, COST OF CAPITAL OR LABOR, COST OF REPLACEMENT OR SUBSTITUTE PRODUCTS, OR LOSS OF TIME. IF NAVICO IS UNABLE TO REPAIR OR REPLACE THE PRODUCT AS REQUIRED HEREIN, THE LIABILITY OF NAVICO TO YOU OR ANY OTHER PARTY SHALL NOT EXCEED THE PRICE ACTUALLY PAID BY CUSTOMER FOR THE CONNECT SYSTEM.
NOTE: SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
6. Who This Warranty Applies To
This limited warranty extends to the original retail purchaser of the Connect System or, if the Connect System is purchased as OEM equipment, then the original retail purchaser of the OEM application fitted with the Connect System. Unless expressly agreed otherwise, this limited warranty DOES NOT extend to any subsequent owner or other transferee of the Connect System.
7. Process for Obtaining Warranty Service
For warranty service, please follow this procedure:
a. Consumers should first contact their dealer for warranty concerns. Dealers must contact their OEM, who will be responsible for submitting the claim directly to Navico.
b. Upon approval, Navico will direct the customer to deliver the application fitted with the Connect System for inspection at a dealer approved by Navico. Navico may require purchase order/proof of purchase as well as a detailed failure description and service report in the event of a field failure which should include repair and troubleshooting attempts, product number, serial number(s) of components and quantities.
c. An RMA authorization must be obtained prior to return. Returns must be delivered to the responsible Dealer or Navico within 14 business days from RMA approval.
d. If the customer is unable to deliver the application to a dealer, written notice must be given to Navico. Navico may then arrange for the inspection and any covered repair at an alternative location of the customer’s choosing. In such case, the customer must pay for all related transportation charges and/or travel time.
e. If the service provided is not covered by this limited warranty, the customer shall pay for all related labor and material and any other expenses associated with that service. THE CUSTOMER SHALL NOT, UNLESS REQUESTED BY NAVICO, SHIP THE CONNECT SYSTEM OR ANY INDIVIDUAL PARTS OR COMPONENTS DIRECTLY TO NAVICO.
8. Who to Contact
Consumers should first contact their dealer for warranty concerns. Dealers should escalate to the OEM. OEM should escalate to Navico Group. Navico Group, a division of Brunswick Corporation, is the company responsible for this limited warranty.
